Official Rules and Regulations
1. Contest Sponsor and Contest Administrator
The “Email Giveaway” (the “Contest”) is sponsored by Explore New Brunswick – Department of Tourism, Heritage and Culture/Tourisme, Patrimoine et Culture, Government of New Brunswick (the “Sponsor”) and administered by Meet.Connect.Explore.NB (the “Administrator”).
2. Eligibility
The Contest is open to legal residents of Canada, including Quebec, (the “Contest Area”) who:
Have reached the age of majority in their province or territory of residence at the time of entry, and
Are not employees, representatives, or agents of the Sponsor or the Administrator, or their respective affiliates, advertising, or promotional agencies, nor immediate family (parent, sibling, spouse, child) or household members of any such persons.
This Contest complies with all applicable laws in the province of Quebec. The Contest is void outside of the Contest Area and where otherwise prohibited or restricted.
Failure to comply with these Official Rules may result in disqualification at the sole discretion of the Sponsor or the Administrator. The Sponsor and the Administrator reserve the right, in their sole and absolute discretion, to disqualify any individual who tampers or attempts to tamper with the entry process, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner with the intent to annoy, abuse, threaten, or harass any other person.
3. Contest Periods
The Contest Entry Period begins at 12:00 a.m. Atlantic Daylight Time on August 12, 2025 and ends at 11:59 p.m. Atlantic Daylight Time on August 19, 2025 (the “Contest Entry Period”). The Contest Period begins at the beginning of the Contest Entry Period and end on September 2, 2026 (the “Contest Period”).
4. How to Enter:
Participants who visit the Meet.Connect.Explore NB booth (#719) at the 2025 Canadian Meetings + Events Expo (CMEE) between August 12 and August 13, 2025, will be eligible to receive a contest postcard. The postcard will contain a QR code, which entrants may scan to access the digital entry form. Entrants must complete the digital entry form in order to be entered into the Contest. When completing the digital entry form, participants may choose to submit their email address to one or more of the following participating Destination Marketing Organizations (each a “DMO”): Rendez-Vous Fredericton, Destination Moncton-Dieppe, and Saint John and Towns by the Bay. An entrant’s decision to unsubscribe to any DMO’s mailing list after entering the Contest will not affect entrant’s participation in the Contest.
Each participant is permitted one (1) contest entry during the Contest Entry Period and must use only one (1) valid email address. Each participant is eligible to win only one (1) prize throughout the entire Contest Period.
Multiple entries by the same person, whether by using different email addresses, identities, or any form of automated submission (e.g., bots, scripts, or macros), are strictly prohibited and will result in disqualification at the sole discretion of the Sponsor or the Administrator.
All entry details must be complete, accurate, and truthful. Providing false or misleading information will result in disqualification and forfeiture of any prize. The Sponsor and the Administrator each reserves the right to disqualify any entrant who violates the letter or spirit of these Official Rules.
5. No Purchase Necessary
No purchase is required to enter or win. Making a purchase will not increase your chances of winning. An entrant is not required to subscribe to one or more DMO’s email update subscription lists in order to be entered into the Contest.
6. Prize Details
Prize: Three (3) prizes consisting of a New Brunswick Gift basket selected at the Sponsor’s discretion (approx. retail value: up to CAD $120) will be awarded from random draws conducted by the Administrator on or about December 2, 2025, March 3, 2025, June 2, 2026, and September 2, 2026 (each, a “Draw Date”) (twelve (12) prizes to be awarded during the entire Contest Period).
Each Prize:
Must be accepted as awarded; and
Is non-transferable and non-redeemable for cash;
The prize is awarded “as is” and the winner acknowledges that the Sponsor and the Administrator has neither made, nor is in any manner responsible or liable for, any warranty, representation, or guarantee, expressed or implied, in fact or in law, relative to the prize or regarding the use, value or enjoyment of the prize. Winner is solely responsible for all taxes, inspection fees, and additional service fees or costs required for use of the prize. No transfer, cash substitution, refund, or replacement of the prize is permitted, except that the Sponsor reserves the right to substitute a prize of equal or greater value in the event the original prize becomes unavailable for any reason. When required by applicable law, the Sponsor will report the name of the winner and the value of the prize to the appropriate taxing authority.
7. Winner Selection
The Administrator shall, on or about each Draw Date, conduct a random draw from among all eligible entries to select three (3) potential prize winners.
The Administrator shall conduct a centralized review to determine whether a selected entrant has previously been declared a winner as a result of being selected by random draw on a prior Draw Date. If a selected entrant has not previously been declared a winner the entrant shall be deemed a confirmed eligible selected entrant, subject to meeting all other conditions herein.
In the event that a selected entrant has previously been declared a winner, the Administrator shall conduct an additional random draw and submit a new entrant for verification, repeating the process until a total of three (3) unique eligible selected entrants are confirmed for each Draw Date.
Failure to comply with any of the above requirements will result in disqualification and forfeiture of the prize, and an alternate winner may be selected at the sole discretion of the Administrator.
8. Winner Notification
Each confirmed eligible selected entrant shall be contacted by the Administrator using a standardized email notification to the entrant’s email submitted. To be officially declared a winner and claim the prize, the eligible selected entrant must:
Respond to the notification within ten (10) Business Days (being Monday through Friday but excluding public holidays in the Province of New Brunswick) from the date of transmission of the notification email;
Correctly answer, without assistance of any kind (mechanical or otherwise), a mathematical skill-testing question administered by the Administrator, in accordance with applicable Canadian laws; and
Sign and return a Declaration of Eligibility and Liability/Publicity Release Form, where permitted by law, within ten (10) Business Days from the date of transmission of the notification email.
It is entrant’s responsibility to keep his/her email address current. Neither the Sponsor nor the Administrator is responsible for any active or passive filtering or insufficient space in a potential winner’s e-mail inbox that prevents the receipt of any message from Sponsor or the Administrator. Failure to comply with these conditions (including the completion of the mathematical skill-testing question and the return of the Declaration of Eligibility and Liability/Publicity Release Form) will result in disqualification and the prize forfeited and selection of an alternate potential winner will be made by the Administrator from among all remaining eligible entries. Winner selection is under the supervision of Sponsor, whose decisions are final.
9. Verification
All entries and selected entrants are subject to verification at any time and for any reason at the sole discretion of the Sponsor or the Administrator. The Sponsor and the Administrator reserve the right to require proof of identity and/or eligibility in a form acceptable to the Sponsor or the Administrator, as applicable, which may include, without limitation:
Government-issued photo identification,
Proof of age and legal residence, and
Any other documentation deemed necessary by the Sponsor or the Administrator to verify compliance with these Official Rules.
Failure to provide satisfactory proof within the timeframe specified by the Sponsor or the Administrator may result in disqualification of the entrant, at the Sponsor’s sole and absolute discretion. In such case, an alternate eligible entrant may be selected.
Providing false, misleading, incomplete, or fraudulent information may result in immediate disqualification and forfeiture of any prize. Proof of submission of an entry or communication (such as screenshots or delivery confirmations) does not constitute proof of receipt by the Sponsor or the Administrator.
All decisions of the Sponsor or the Administrator with respect to the verification of entries and eligibility of entrants are final and binding.
10. Odds of Winning
Odds of winning depend on the total number of eligible entries received during the Contest Entry Period.
11. General
By participating in this Contest, all entrants agree to be bound by these Official Rules. Contest administration and winner verification will be supervised by the Sponsor and the Administrator, whose decisions are final. Entrants waive the right to contest any decision by the Sponsor or the Administrator concerning any aspect of the Contest, the interpretation of the Official Rules or the determination of qualification of entries. Neither the Sponsor nor the Administrator shall be responsible for any mail, e-mail or computer delays, malfunctions, disruptions, or unavailability regardless of cause, including technical, hardware, software, telephone, Internet, network problems or virus contamination. The Sponsor and the Administrator shall not be responsible for technical, pictorial, typographical or editorial errors or omissions in any marketing materials or these Official Rules. The Sponsor and the Administrator are not liable for technical issues like late entries, system failures, or lost emails. The Sponsor and the Administrator shall not be responsible for any other delay, failure, or malfunction in connection with Contest administration, including, but not limited to, errors by the Sponsor or the Administrator and their representatives who enter incorrect information into any of the Sponsor’s or the Administrator’s systems. The Sponsor is not responsible for delays or disruptions caused by third parties or force majeure. The Sponsor and the Administrator each reserve the right to disqualify any entry from the Contest if in the Sponsor’s or the Administrator’s sole judgment the entrant has not complied with these Official Rules.
12. Limitation of Liability and Release
By entering this Contest, participants agree to release and hold harmless the Sponsor, the Administrator and their respective affiliates, partners, directors, officers, employees, and agents from any liability for any claims, losses, or damages arising out of participation in the Contest or acceptance/use of the Prize.
13. Privacy and Consent
By entering the Contest, participants consent to the collection, use, and disclosure of their personal information for the purposes of administering the Contest and receiving marketing emails (in accordance with their preferences), all in accordance with Meet.Connect.Explore's privacy policy available at [insert Privacy Policy URL]. This includes compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA), the Act respecting the protection of personal information in the private sector (Quebec) and Canada’s Anti-Spam Legislation (CASL).
Participants can withdraw consent to receive promotional emails at any time via the unsubscribe link in promotional emails.
14. Right to Cancel or Suspend
The Sponsor reserves the right, at its sole discretion, to cancel, modify, suspend, or terminate the Contest in the event of:
A technical failure (e.g., corrupted files, bugs, unauthorized human intervention),
Fraud or other errors that compromise, or could compromise, the integrity or proper functioning of the Contest,
The Contest is not capable of running as planned or fairly, or
Regulatory or legal requirements.
15. Publicity
By accepting the Prize, the winner grants the Sponsor and the Administrator the right, where permitted by law, to use their name, city/province of residence, and photograph or likeness for publicity purposes, without further compensation or notice.
16. Disputes
Any and all disputes, claims, and causes of action arising out of or connected with this Contest or the prize awarded and all issues and questions concerning the validity, interpretation and enforceability of these Official Rules shall be resolved individually, without resort to any form of class action, exclusively in a court of competent jurisdiction sitting in the Province of New Brunswick without regard for conflicts of law doctrine. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest and never shall include consequential, incidental or punitive damages, attorneys' or experts’ fees, which are expressly waived. Some jurisdictions do not allow the limitation or exclusion of liability, so some of the above may not apply to you.
17. Governing Law
This Contest is governed by the laws of the province of New Brunswick and the applicable laws of Canada, except for residents of Québec, for whom the Contest is governed by the laws of the province of Québec and the applicable laws of Canada. Void where prohibited.
